When looking for an outside firm to manage your trade compliance programs, the general tendency is to turn to one of the “big name” service providers. These firms entice potential clients with fancy sales presentations touting one-stop shopping and an impressive suite of services. They capitalize on the initial sense of security that comes from doing business with an established firm. While the firm may be well established, the question remains as to how much relevant experience its employees have. After all, you’ll be placing your compliance “life” in their hands. Do you even know who these people are, and more importantly, are they qualified to be making crucial compliance assessments on your behalf? Even if they are qualified, will they still be with the firm, or dedicated to your account, in six months or a year? These are questions that need to be answered to your satisfaction before you sign on the dotted line, because no matter who manages your compliance programs, as the importer or exporter, you are ultimately responsible.

My name is Jim MacNeill. I received my Customs broker license in 1995. I started assigning HTS codes in 1993, when I managed the account of the third largest computer importer in the United States (at the time). Since then, I have specialized in HTS classification, primarliy in the field of automotive and machinery service parts. Most recently, I served as Senior Classification Analyst for American Honda Motor Company, Inc., where I managed all import classification processes and operations, implemented system upgrades to increase the efficiency of those processes and operations, and classified thousands of service parts. During that time, I also organized several Customs Automotive Round Table (CART) classification conferences, which provided an open forum for members of the automotive trade to discuss ruling determinations and HTS classification of automotive service parts directly with National Import Specialists from CBP's National Commodity Specialist Division (NCSD) in New York. These conferences illustrated the existing confusion in the automotive trade over the classification of service parts, with a particular focus on classification binding ruling results that the trade viewed as "inconsistent" or "erroneous". In many cases, importers were simply not sure which rulings they could rely upon, and as a result, were becoming more hesitant to file ruling requests for service parts. And that's when it hit me: the automotive industry needed a single entity to review published ruling results on an ongoing basis, break them down with solid and easy-to-understand classification analysis, and compare them to existing ruling results for similar merchandise, and determine whether the result was acceptable or not. Simple.
That's why I decided orignally to create my monthly newsletter, which has since transformed into the AutoRuling Database (ARDB) Platform ... a complete solution for identifying and managing classification binding rulings that relate to automotive service parts and accessories .
